President's Report

From the President's Desk

By:  Jim Wickham CMB
2018 MMLA President
Union Home Mortgage Company

Summer is here at last!  Great time to live in Michigan, even better time to be a member of the MMLA.  We have had a few golf outings in recent weeks and great participation at each of them.  Thank you to the committees for putting those together, it takes a tremendous amount of time and effort from a handful of individuals to pull these off.  Great turnout and engagement, so again our thanks to those committees for doing all that was needed to make them a reality.

Industry news has been fairly quiet as of late.  Summer volumes are not as robust as many hoped and many have agreed the lack of inventory is the root cause of this.  When we don’t have enough activity in the new construction segment it trickles down to all other areas of the real estate market.  We have struggled to keep up with demand in recent years, many ripple effects from the last recession and many of them still firmly hitting our industry.  Unfortunately, the combination of rising interest rates and lack of inventory has dampened production for many in the mortgage industry.  When volumes decline unfortunately so does employment.  This has been a rough few months with layoffs becoming all too common.

When volumes are down as an industry we tend to look inward and take a really deep dive into our operations.  Many companies will take a good look at all aspects of their business when times are tough.  As many have read and heard, leave no stone unturned.

We have an amazing Lending Conference every summer, and thankfully our next one is right around the corner - August 15 – 17 at Crystal Mountain Resort!  We have plenty of speakers and sessions to guide all of us when taking a good look at how we operate and how we will grow our business in the future.  Great time to learn, see your peers, and hopefully take in a little golf with some old friends.   Wonderful speakers, fantastic networking, fun golf outing – learn and relax at this great event.  Click here for all the details and to register today!   We hope to see a great mix of veteran members as well as first time attendees.  We look forward to hosting all of you “Up-North” in August.

Legislative & MORBANPAC Committee News

Legislative and MORBANPAC Committee Update

by:  Todd Potter, CMB, Chairman
Level One Bank

As many of you may know, the Economic Growth Regulatory Relief and Consumer Protection Act was signed into law by President Trump on May 24, 2018.  The Bill amends some of the regulations imposed by Dodd-Frank after the financial crisis of 2007-2008.  One provision that I would like to mention to our MMLA membership is the addition of transitional licensing language for mortgage loan officers under the SAFE Act.  Under the old rule, the SAFE Act requires mortgage loan originators (MLOs) employed by non-depository lenders to be licensed, which includes pre-licensing and annual continuing education requirements, passage of a comprehensive test, and criminal and financial background reviews conducted by state regulators. These MLOs are also registered in the National Mortgage Licensing System and Registry (NMLS).  By contrast, MLOs employed by federally-insured depositories or their affiliates must only be registered in the NMLS, and do not have to meet testing and specific education requirements.

The passage of the Economic Growth Regulatory Relief and Consumer Protection Act makes a minor change to the SAFE Act to require states to issue transitional licenses to individuals who were employed by a financial institution and are a registered loan originator.  These individuals would be able to continue originating loans for 120 days after being employed by a state-licensed non-depository entity.  Similarly, a state-licensed loan originator in one state who takes a similar position in another state would have a 120-day grace period to obtain a license in the new state.  The Legislative Committee of the MMLA and Karoub (who represents the interests of the MMLA in Lansing) are reaching out to representatives at the Michigan Department of Financial Services and the Director of Consumer Finance to start a discussion regarding their timeline to adopt the revisions of the SAFE Act in Michigan.

The Legislative Committee also monitored the passage of SB 664 (Electronic Notarization) and HB 5811 (Remote Notarization).  Both Bills are expected to be sign by Governor Snyder into law this summer.  Michigan will join Tennessee, Minnesota, Vermont, Indiana, Virginia, Montana, Texas and Nevada in permitting remote online notarization (RON). We would be the fifth state in 2018 to enact legislation related to RON.

In 2017, the members of the Michigan Realtors® were able to raise $1.03 million towards their RPAC.  By drastic contrast, the membership of the MMLA raised $14,461 over that same period toward MORBANPAC.  The MMLA in partnership with Karoub & Associates needs your support to properly sponsor and/or defend proposed legislation in Michigan.  With 40+ Bills we are monitoring and the change in the political landscape here in Michigan this fall, please consider a one-time donation to MORBANPAC.  A united voice is an effective voice!! As always, your contribution to MORBANPAC is imperative that our voice is strong in Lansing. Click here to learn more about MORBANPAC and make your contribution today.

Education Committee News

Education Committee Update
Audrey Acquisti, MMLA Education Consultant
MSource Training & Consulting

The MMLA Education Committee is finalizing plans for our annual Compliance Conference.  The conference has been scheduled for Thursday, September 20th, at Crystal Gardens, 5768 E. Grand River Ave., Howell, 48843.  Doors open at 8:30 AM.  The conference will conclude at approximately 3:00 PM.

Our speaker lineup this year, while not completely confirmed, will cover topics that we feel will be of interest to our members.  An esteemed panel has been created to discuss these topics:

Third Party & Vendor Management Risk – The world is becoming a riskier place. Regulation brings a new level of complexity. And the interconnectedness of business relationships requires a greater level of risk management sophistication. Never has there been more incentive and momentum around third-party risk management, especially within the highly-regulated financial services market segment.  Learn how third-party risk management has progressed beyond simply complying with regulations and how other financial institutions are growing these initiatives.

TRID 2.0 -  TRID 2.0 addressed many of the pain points that our industry has struggled with over the past two years.  The new rule is mandatory October 1, 2018.  From a CFPB-watchers perspective, it appears that the Bureau heard and responded to the mortgage industry’s concerns, but there are still a handful of large issues that remain.  While the CFPB has closed the “black hole” issue that generally prevents lenders from re-setting fee tolerances when a CD has been issued prematurely, we are still dealing with TRID questions and varied interpretations. Concerned about unintended consequences?  Join us on Sept. 20th.

Digital Advertising – Discover how to slice through the digital advertising noise and still stay compliant.  Digital Advertising is an awesome avenue to build your brand and make sales…but only if you do it right.

DIFS State Audits – When should you expect a state audit?  Who has access to audits performed by a state regulator?  What are the areas of concern they will concentrate on? Are all state audits the same?  Who in my organization should be involved in the audit?  Will state auditors speak with other company personnel?  What do they do BEFORE they step through my door?

Cyber Security – The hot topic that has everyone looking at their systems, business and personal, to make sure they are prepared and secured.  We will give tangible examples of what is happening and how to prevent it from happening to you!

Get answers to these questions any many more if you attend the MMLA Compliance Conference on September 20th.  Everyone is welcome, our speakers will provide great information to assist sales staff, operational staff, and senior management alike.   Stay tuned for more info and to register coming soon to your email and on our website at www.mmla.net and click on the events tab.

It is unbelievable that we are half way through 2018.  Business has been keeping us all on the run.  I am personally looking forward to attending my first MMLA Annual Lending Conference at Crystal Mountain on August 15th-17th.  I have heard great things about this conference and I look forward to learning new things and networking!  I hope to see you there!

Our next event is, in my opinion, the most exciting of all of our events here in the middle of the state.  On August 23, we will join our local Women’s Council of Realtors for this jointly run Golf Outing.  We will meet at 8:30AM at Royal Scot Golf Course for a day of golf, good food, games and mingling.  Now if the weather will please cooperate!

Stay tuned for more fun events that are currently in the works for this fall!

SE Chapter News

SE Chapter President's Corner
Kirk King
SE Chapter President
Continuity Programs, Inc.

By now, we have mostly recovered from the SE MMLA Friday Golf Outing.  I am sure those who attended really enjoyed themselves at Boulder Pointe, plus we great weather again (big thanks to Dawn Burdick, Marc Faber, and Trinity Lancione).  We will be moving the golf outing next year back to Thursday to improve attendance.

If you have not registered for the Annual Lending Conference, please do that sooner than later.  We are going back to Crystal Mountain this year, so you do not want to miss that.  We are also limited on the number of golfers at Crystal Mountain, so we will definitely sell out - so sign up for that at the same time.

We are planning to Raise The Roof at the next social event with a roof-top venue at Duggan’s in Royal Oak, so hold the afternoon of August 2nd.  We are looking for a sponsor or two to help offset costs of this event. Click here to sponsor or to register.

The next luncheon will be back at Maggiano’s October 4th, because we cannot beat the location, great food, service, and of course the delicious desserts.  We are also planning to bring in a very dynamic speaker, Realtor Jeff Glover!  Please plan now to attend and bring a friend (referral partner) to attend with you.  Click here to sponsor or to register.

Paula Rosneck and her team are going to throw an incredible holiday party on December 13th.  Paula and her team have decided to raise the bar when it comes to the venue, and we will be partying at the Iroquois Club.  Everyone will want to be there for sure; I heard the food there is to die for.

For those windshield warriors like myself, I look forward to seeing you on August 23rd for the Mid Chapter Golf Outing.

I am so honored to serve the MMLA and all of you since the beginning of 2016 and I am often in awe of the quality of volunteers that go above and beyond!

Cheers, Kirk King of Continuity Programs
